I John Bitick do Solemnly Swear to the best of my belief that Thomas Bitick

died without a will So fair as I do Know and believe

and that I will make a true and perfect inventory

of and faithfully Administer all the Estate of Said decd

and pay all Just debts as far as the assets will extend and

the law direct and account for and pay all assets which

may come to my hands or Knowledge and also that

the following is a true list of the heirs of Said deceased the 

age and place of Residence

as principal and Francis Wallis and John Carrol

as Securities are held and firmly bound unto the State

of Missouri in the Just Sum of five hundred Dollars

Good and Lawful money of the United States and

for the true payment of the Same we bind Our Selves

our & each of our hiers Jointly and severally firmly by

these presents Signed with our hands and Sealed with

our Seals and dated this 7th day of August 1838

        The Condition of the above obligation is

Such that if the above bound John Bitick Admn

of Thomas Bitick deceased Shall faithfully Administ

=er Said Estate account for pay and deliver all money

and propertys of Said Estate and perform all other

things touching Said Administration according to

law or the order of any Court having Competent

Jurisdiction then the above bound to be Paid otherwive

these presents Shall Come Greeting whereas Thomas Bitick late of

Gasconade County died intestate as it is said and you John S.[?] Bittick, hav[i]

=ng given Good and Sufficient security I do therefore Give and Grant

unto you full power and Authority to adminster all and singular

the Goods and Chattles rights and cridets [credits?] of the said deceased and

to demand collect and Receive and in a legal manner require all

manner of Debts due to and owing to said Deced and will and

faithfully to dispose of the same according to law and I do

lastly appoint you the lawfull administrator of said

Bittick comes into Court & filed his petition praying

for the sale of as much of the real estate of the said

deceased as will be sufficient to pay the debt of the

said estate which petition being accompanied by a

statement of the situation of the said estate verifies by

the offi ercourt [officer or official??] of the said court by which it appears

that the personal assets in his hands are

not sufficient to pay the debts owe by said

estate

            Therefore it is ordered by the Court that

all persons interested in this estate be

notified that unless just cause to the contry

be shown at the next Term of this Court

to be bjiun [begun?] & held on the 3rd Monday

here that he had fully exhausted the

personal assets which have come to his

hands in the above mentioned estate
